Employment applicant privacy notice

This Employment Applicant Privacy Notice (“Applicant Notice”) describes how Kin collects and uses your personal data when you interact with the Kin careers website or apply for a job at Kin.  As part of the application process, Kin needs certain personal data to evaluate your application and, for candidates who are offered jobs at Kin, to prepare for those applicants to join Kin.  This includes things like background checks, benefits eligibility, paying wages, fulfilling Kin’s contractual requirements, and fulfilling Kin’s legal obligations under state and federal employment laws. This Applicant Notice is not an offer of employment or a promise of employment, nor will it be part of a contract of employment.

This Applicant Notice extends to positions with Kin Insurance, Inc., and its affiliate companies (collectively “Kin”). Kin may update this Applicant Notice from time to time in its sole discretion. Updates to this Applicant Notice will be posted here.  This Applicant Notice applies only to candidates applying to positions at Kin and does not apply to consumers interacting with Kin’s products and services, which are subject to the Kin Privacy Policy available at www.kin.com/privacy/.

Kin collects the following categories of data about you when you interact with the Kin careers website and apply for a job with Kin as well as any other information you voluntarily choose to disclose to Kin in your resume, cover letter, application, or during the interview process.

Personal Information Identifiers and Past, Present and Future Employment Data including name, postal address, date of birth, unique personal identifier, email address, social security number, state identification card number, passport number, driver’s license number or other similar identifiers, educational background, work history, education, compensation history, resume and cover letter, job title, and professional certifications and memberships as well as any other information you may voluntarily choose to disclose to Kin in your resume, cover letter, application, or during the interview process.

Kin uses this data to evaluate your application, review your qualifications, make decisions about your candidacy, comply with applicable state and federal employment laws, communicate with you about your application, to process your application, to comply with Kin’s legal requirements, and, for candidates who are offered a position with Kin, to set up background checks, payroll, and employee benefits.

Identification Information and Personal Characteristics Age, race, ancestry, national origin, citizenship, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, protected classifications including citizenship, visa status, and nationality as well as any other information you may voluntarily choose to disclose to Kin in your resume, cover letter, application, or during the interview process.

Kin uses this data to comply with applicable state and federal employment laws, to comply with Kin’s legal requirements, and, for candidates who are offered a position with Kin, to set up employee benefits.

Location Data, browsing history, search history, and information regarding your interaction with the Kin website

Kin collects and uses this data to identify your location and interactions with the Kin careers website. 

Sensitive Personal Information including Health and Medical Data, Criminal Records Data, and Race or Ethnicity Data. Sensitive personal information we collect includes Social Security number, driver’s license number, state identification card number, passport number, customer account log-in, financial account number, precise geolocation information, racial or ethnic origin, results of background checks, personal health information, gender, accommodation requests including during interviews, and disability status as well as any other information you may voluntarily choose to disclose to Kin in your resume, cover letter, application, or during the interview process.

Kin collects and uses this data to comply with state and federal equal opportunity laws, to perform background checks, to accommodate you during interviews, and to administer benefits to employees.



Collection, use, and processing of your personal information

When you interact with the Kin careers website and apply for a job with Kin, Kin collects and uses your data to evaluate your application, review your qualifications, make decisions about your candidacy, comply with applicable state and federal employment laws, communicate with you about your application, to process your application, to comply with Kin’s legal requirements, and, for candidates who are offered a position with Kin, to set up background checks, payroll, and employee benefits. Kin will only collect, use or process sensitive data when allowed or required by law, including in the United States for equal opportunity purposes which require information about race, gender, ethnicity, disability, and related information in order to comply with federal equal opportunity legislation, for the purposes of performing background checks to lawfully protect against security risks, and data related to health and health condition in order to provide accommodations, assess fitness to work, to manage and administer benefits, and to comply with legal and contractual requirements. 

Legal basis for collecting, using and processing your personal information

Kin collects, uses, and processes your personal information pursuant to the following legal bases:

  • Assessment of applicant candidacy for a job at Kin and handling of applicant on-boarding for positions at Kin, as allowed under data privacy laws;

  • Legitimate interests of Kin and third parties, including sharing information with company affiliates, human resources management, workplace safety, Kin network and system security, fraud prevention, internal investigations, dispute resolution, due diligence response, participation in transactions involving the company,  and compliance with the law;

  • Compliance with legal obligations, including local, state, and federal employment laws, rules, and regulations, and relevant data privacy laws; and

  • Explicit consent, as allowed under data privacy laws.

Disclosure of personal information

Kin will only share your personal data with third parties where required. Your personal data is shared with third parties as follows:

  • With Kin’s parent company and affiliate companies, and service providers pursuant to contractual obligations;

  • With third party service providers that offer services to Kin to facilitate Kin’s on-going business operations and resolution of disputes, such as tax advisors and legal counsel;

  • With a state regulatory agency to confirm an applicant’s insurance licensure; 

  • To address legal requirements in maintaining Kin’s business operations, including in the areas of state and federal employment law compliance;

  • For human resources management purposes, including screening for open positions;

  • In the event of investments, mergers and acquisitions, sales, transfers, sale of company, or related due diligence purposes; and

  • With local, state, and federal government entities, regulatory authorities, and other third parties where legally required. 

We do not sell your personal information

We do not disclose your personal data to non-affiliated third parties for those third parties’ direct marketing purposes, nor do we sell your personal data. 

Transfer of your personal information

Personal data shared with Kin is stored in the United States and other countries outside of the European Economic Area. Kin does not do business in the European Economic Area.  Where data is transferred by Kin from the European Economic Area, Kin would engage in contractual relationships with third parties pursuant to EU and UK Standard Contractual Clauses. 

Retention of your personal information

Kin will retain your personal information as long as required to fulfill Kin’s processing needs, and in compliance with applicable law. Kin may retain backup copies of your personal information for an additional amount of time. 

Right to access your personal information

Under applicable data privacy laws, rules and regulations (“Data Privacy Laws”), you have the right to request that we disclose certain information about our collection and use of your personal information over the past twelve months, including: the categories of personal information collected about you; the specific pieces of personal information we have about you; the categories of sources from where personal information was collected; the business purpose for collecting the personal information, and the categories of third parties with whom we share personal information. 

Right to deletion of personal information

Under the Data Privacy Laws, you have the right to request we delete the personal information we collected, with certain exceptions. We will delete your personal information in response to a verifiable request unless needed for the following: in the context of evaluating your candidacy for open positions at Kin, to take actions reasonably anticipated within the context of our ongoing screening of your resume or qualifications for positions at Kin; to comply with legal obligations including local, state and federal employment laws; to enable solely internal uses that are reasonably aligned with reasonable expectations based on your interaction with us related to potential employment; or to otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information related to your employment with Kin.

Additional rights related to personal information

Depending on your location, for data subjects outside of the United States, you may have additional rights under the Data Privacy Laws including the right of rectification that allows you to correct inaccuracies in your personal information, right to restriction of processing, right to object to automated decision-making, and the right to withdraw consent to Kin’s processing of your personal information.

Pursuant to your applicable Data Privacy Laws, applicants located in certain jurisdictions including the European Economic Area, California, and other jurisdictions can submit a request by contacting us at the address, email, or telephone number listed below.

Security of personal information

Kin is committed to protecting your personal information.  We have measures in place to prevent personal data from being lost, or from being used or accessed in an unauthorized way. We have policies in place that regulate how our employees and contractors must handle data, including personal data about you. We limit access to our premises and to our computer networks, and take steps to safeguard against unauthorized access to such premises and networks. We have procedures in place to manage any suspected data security breach and will notify you and any applicable regulator of a suspected data security breach consistent with legal requirements.

Changes to this applicant notice

Kin updates this Applicant Notice when necessary in response to changes in our data collection or processing practices or policies, changes to our products or services, or other changes to our business practices. If we make changes, we will post the revised Applicant Notice here, and will change the “Last updated” date at the top of this Applicant Notice, so that you can see what information we gather, how we might use that information, and in what circumstances we may disclose it. If there are material changes to this Applicant Notice, we will notify you by posting a revised notice on our job application website.
